SNIES Code: 54098
Title : Doctor in Litigation Contemporary
Duration : 8 levels
PhD in Contemporary Litigation proposed by the University of Medellin aims to train high-quality researchers with the capacity to perform autonomously and guide academic and research processes in procedural law. Because of this, their proposals will be an original and significant contribution to the advancement of professional legal field and for the administration of justice in Colombia.
The study of procedural law, as a complex system demands to be confronted with the cultural environment in which it is inserted, it can not ignore the social and political reality in which man is circumscribed; this requires the development of a theoretical and contemplative attitude towards some practical ideas to guide the ongoing review of the concepts provided by the procedural dogmatic, seeking the development of his theories and institutions, providing adequate production of procedural rules .
It is imperative to reorient the discursive interest, ensuring a constant dialogue between the procedural legal doctrine and other legal disciplines such as: contemporary constitutionalism, philosophy of law, comparative law studies between the practices of common law and civil law and the law national and supranational among others. This dynamic allows us to adapt the object of knowledge to the constant transformation of procedural law as a complex system, enabling procedural law be reformulated as a system of guarantees and at the same time is a real mechanism of action of substantive law, to facilitate the renewal of their thematic content and rethinking of traditional conceptual models.
Additionally attention in globalizing trends duty is fixed, that is, the study of international standards and reflection on Human Rights, International Humanitarian Law, the International Law of Human Rights and International Criminal Law, accompanied a critical and holistic analysis that does not depart from the Colombian reality, since a new order given by the construction and acceptance of jurisdictions and global courts is imposed, responsiveness and binding force of international mandates it imposes on domestic legislation and binding force is recognized the doctrine contained in the law of international organizations.
And finally, it becomes inexorable, under this new light, approach the study of due process as one of the most important contemporary legal developments for procedural law, can not be regarded as a timeless, uncritical, mechanistic system (purely instrumental view ) but, on the contrary, as a system of guarantees which allows free access to the justice system and ultimately, the achievement of justice materialized.
So, the doctorate is aimed at development and evolution of procedural law from such scientific or research itself, incorporating the philosophical and legal disciplines economic outlook, policy Litigation before the XXI century, through two lines research that support the program: 1) Judicial Justice to social justice, 2) Towards a new hermeneutic for the judgment.
Similarly, the following academic emphasis is adopted: 1) Litigation Contemporary, national and supranational law enforcement, 2) processes and supranational constitutional mechanisms for the protection of the environment; and 3) legal relations - economic national and international procedural mechanisms.
The Doctor in Litigation Contemporary will be able to design, conduct and complete any investigation in the procedural area, which is our cross-cutting work.
The Doctor of Procedural Law, a researcher who is, will deal appropriately with any pragmatic conceptual field, not only in the exercise of their profession, as an advisor or consultant, but also on the performance of the judiciary or university teaching in the negotiation of conflict through alternative methods and in general, any matter related to the endless legal, philosophical, sociological and psychological horizon procedural level in the order of the nation state and the supranational order.
